Disclaimer
1) This Application shall be accompanied by a Cheque/Demand Draft/pay order/ RTGS proof payable at Chandigarh or at Par, drawn in favour of Vibrant Heights Private Limited towards the amount of the earnest money payable.
2) This Application constitutes an offer to acquire a residential Flat/ Apartment on the terms & conditions of allotment and sale thereof as made and laid down by Vibrant Heights Private Limited (herein after referred to as “The Developer”). The Application doesn’t confer any right of allotment & the Developer reserves the right to accept or reject any application in its sole discretion and without assigning any reason for the same.
3) In case the number of applications are more than the flats available, then the Public draw of all applications will be held and the result of draw will be uploaded/declared/posted on the address as mentioned in this application form/brochure. Individual intimations will be sent to those successful in the draw.
4) Second draw of lots will be held after 90 days (i.e. on 15th April 2025) from the date of first draw. Second draw will be held for the flats which have become available on account of the previously successful applicants (from 1st draw) surrendering or not furnishing requisite documents or consideration (payment) and the company has cancelled previously allotted flats of such applicants.
5) For all the unsuccessful applicants even after first and second draw of lots their earnest money amount will be refunded with in 15 days from the date of second draw.
6) If the applicant is successful then the Allotment letter will be issued and later on Flat/ Apartment Buyer Agreement would be executed between both the parties, spelling out details of the Terms & Conditions of the Allotment binding on both the parties.
7) That the mere submission of the application shall not vest any right with the Applicant herein to get Allotment of a flat in the Project and the said right shall be vested only on the issuance of Allotment letter and only for the successful applicants.
8) On the issuance of the Allotment Letter by the developer, to the successful applicants, the Earnest money shall be treated as a part of initial payment & balance payment is to be paid in accordance with the schedule of payment with its Terms & Conditions wherein the time shall be of essence.
9) The application form and allotment thereof is non-transferable and non-saleable.
